Limitation of Liability

Huongdanviendulich.vn is an intermediary platform connecting Tour Guides, Travel Partners, Tourists, and Affiliates. We provide services to support tour booking/Tour Guide hiring, hold payment funds, and provide information related to the tourism sector. We are committed to making every effort within our capacity to control and verify information posted on the website. However, to ensure transparency, we set out the following limitation of liability policy.

1. Intermediary Role

The Website operates as a connecting platform, providing a space for Tour Guides, Travel Partners, and Affiliates to promote their services to tourists. We are not a tourism service provider, do not directly conduct tours, and are not responsible for the quality of services provided by the parties. All transactions, agreements, or contracts are conducted directly between customers and service providers (Tour Guides or travel companies). We only assist in resolving disputes within our capacity and do not resolve disputes on behalf of either party or issue a final ruling.

We act as an intermediary holding payment funds between Tour Guides, Travel Partners, Tourists, and Affiliates, ensuring payment in accordance with the agreement. However, we are not responsible for disputes arising from payments made outside the platform or breaches of agreements between the parties. For Affiliates, commissions are paid according to the policies of Tour Guides and Travel Partners; we are only responsible for making payments when the service has been recorded as completed and complies with the platform's regulations.

2. Responsibility for Information

We are committed to making efforts to control and verify, within our capacity, the input information (information about Tour Guides, Travel Partners, and tour services) posted on the website. However, huongdanviendulich.vn does not guarantee the accuracy, completeness, or legality of all information provided by Tour Guides, Travel Partners, and Affiliates. We are not responsible for any damage arising from the use of information on the website, including but not limited to misleading, inaccurate, or outdated information. Customers are advised to independently check and verify information about Tour Guides, Travel Partners, or services before conducting a transaction.

3. Limitation of Liability

Regarding tourism services: We are not responsible for the quality, accuracy, or safety of tourism services provided by Tour Guides or Travel Partners. Customers must independently assess and negotiate directly with the tourism service provider before using the service. The platform acts as an intermediary to assist the parties in communicating and provides information and evidence (chat history, contracts, and reviews) so that the parties can negotiate and resolve disputes themselves. We are not responsible for any damage (including but not limited to property, health, or financial damage) arising from the use of tourism services connected through the platform, except where such damage is directly caused by our fault.

Regarding payments: We hold customers' payment funds and transfer them to Tour Guides and Travel Partners in accordance with the agreement. However, we are not responsible if the parties provide inaccurate payment information or breach the contract. Refunds (if any) are subject to the policies of the Tour Guides and Travel Partners providing the services; we only assist in processing refunds upon receiving a valid request from the relevant parties and in accordance with the platform's regulations. In the event of technical problems (such as payment system or bank transfer errors), we will make efforts to resolve them within our capacity but are not responsible for indirect damage arising from these incidents.

Regarding Affiliates: We only pay commissions to Affiliates when a transaction is confirmed as completed and meets the prescribed conditions. We are not responsible if an Affiliate does not receive a commission due to a policy violation or because the transaction is unsuccessful/incomplete. Affiliates bear full responsibility for their conduct during the promotion or introduction of services; we are not responsible for any disputes, complaints, or damage arising from an Affiliate's inappropriate conduct.

Regarding content on the platform: Information about Tour Guides, Travel Partners, or tourism services is provided by the relevant parties. We do not guarantee the accuracy, completeness, or currency of such information and are not responsible for damage arising from the use of information on the platform. The platform may contain links to third-party websites or services; we do not control the content or activities of these websites and are not responsible for any damage arising from accessing or using such links.

4. Force Majeure

We are exempt from liability for failure to perform our obligations due to force majeure events, including but not limited to natural disasters, war, strikes, technical incidents beyond our control, or newly enacted legal regulations. In such cases, we will promptly notify the relevant parties and make efforts to minimize damage.

5. User Responsibilities

Users of the platform must comply with Vietnamese law, the platform’s regulations, and agreements with relevant parties. Users are responsible for providing accurate and complete information when registering, conducting transactions, or using services on the platform. We are not responsible for any damage arising from inaccurate or incomplete information. Users are responsible for keeping their account and transaction information secure; we are not responsible for any damage arising from an account being compromised due to the user’s fault. Customers should carefully read the terms, conditions, and policies of the Tour Guide or travel company before booking services, carefully check information related to travel insurance, tour cancellation conditions, and relevant regulations before participating, and contact the Tour Guide and Travel Partner directly to confirm the information if they have any doubts.

6. Legal Rights

We do not guarantee that transactions on the platform will always be successful, uninterrupted, or fully meet users’ expectations. In all cases, our liability (if any) shall be limited to the service fee we receive from the relevant transaction, unless otherwise provided by law.

Important Notice

These limitations of liability do not exclude or limit the platform’s liability in cases of intentional damage or serious violations of the law (in accordance with mandatory provisions of Vietnamese law).
